  1. Introduction

    1. These General Terms and Conditions of Sale (GTC) govern sales made on the Atelier du Fard Sàrl website (hereinafter ‘the Website’) as well as purchases made in the showroom. By placing an order on the Website or making a purchase in the showroom, you unreservedly accept the GTC in force at the time of the order.
    2. The Website is operated by Atelier du Fard Sàrl, whose registered office is located at Avenue des Figuiers 1, 1007 Lausanne, Switzerland, registered in the commercial register under number CHE-451.909.986.

  3. Products

    1. The products offered for sale are those described on the Website. Product descriptions, photos, characteristics and ingredient lists are provided for informational purposes only and are subject to change without notice. Only the ingredient list on the product packaging is authoritative. For further information on ingredients or product specifications, we recommend that you contact the manufacturer directly.
    2. Some products may contain allergens (e.g. fragrances, preservatives, pigments). It is the customer's responsibility to check the list of ingredients on the packaging and, if necessary, to carry out a preliminary tolerance test. In the event of a known allergy, the customer must refrain from using the product in question. Atelier du Fard Sàrl cannot be held liable for any reaction resulting from individual sensitivity, failure to follow the precautions for use, or improper use.
    3. Products are subject to availability. If a product is unavailable after your order has been confirmed, we will inform you as soon as possible and offer you either a replacement product or a refund.
    4. Some products may be available for pre-order. Details regarding pre-orders will be specified on the Website at the time of purchase. (see ‘Pre-orders’)

  5. Orders & Quotations

    1. To place an order, you must create an account on the Website or provide the necessary information for delivery and billing.
    2. The order is only considered final after confirmation by Atelier du Fard Sàrl. You will receive a confirmation email with a summary of your order.
    3. Atelier du Fard Sàrl reserves the right to cancel or refuse any order in the event of a payment issue or failure to comply with the Terms and Conditions.
    4. When confirming their basket, customers have the option to select ‘Quote’ instead of proceeding directly to payment. This option automatically generates a summary email containing the order details, which serves as an official quote issued by Atelier du Fard Sàrl.
    5. Quotations are valid for 30 days from the date of issue. After this period, Atelier du Fard Sàrl reserves the right to modify prices, product availability or associated conditions.
    6. To confirm a quote, the customer may:
      1. Validate it directly from your customer account on the Website, or
      2. Proceed with payment to convert the quotation into a firm order, or
      3. Please contact us for any changes before validation.
    8. No goods are reserved until the quotation has been confirmed and paid for. Atelier du Fard Sàrl cannot guarantee the availability of products or the delivery times mentioned before the quotation has been confirmed and paid for.

  7. Pre-Orders

    1. Some products can be purchased on pre-order. When pre-ordering, you have the option to choose the following shipping option:
      • Shipment upon availability: The product will be sent as soon as it is available in stock.
      • Combined shipping: The order will be shipped once all products, including pre-ordered items, are available.
    3. By choosing the combined shipping option, you agree that your order may be delayed until all products are available.
    4. Delivery times for pre-ordered products will be specified on the Website at the time of ordering. Atelier du Fard Sàrl will make all reasonable efforts to meet the announced delivery times, but cannot be held responsible for any delays.

  9. Vouchers

    1. Vouchers issued by Atelier du Fard Sàrl are valid for 5 years from the date of purchase.
    2. Vouchers are not exchangeable for cash and are non-refundable.
    3. They can be used in instalments until the balance is exhausted.
    4. Les bons d'achat peuvent être utilisés pour régler des achats sur le Site ou au showroom, dans les limites des produits disponibles.

  11. Prices and Paymens

    1. The prices displayed on the Website include VAT for orders delivered in Switzerland and exclude VAT for international orders. No Swiss VAT will be charged for shipments outside Switzerland.
    2. For international orders, the buyer is solely responsible for paying any local taxes, customs duties, import duties or any other taxes that may be applied by the destination country. These charges are not included in the prices displayed or in the delivery charges invoiced by Atelier du Fard Sàrl.
    3. Delivery fees are not included in the product price and will be added to the total amount of the order.
    4. Payments can be made via Twint, PayPal, credit card or bank transfer. Payment must be made before the order is dispatched, including for payments by bank transfer.
    5. Under certain exceptional circumstances, shipment prior to payment by invoice may be granted, subject to prior written agreement from Atelier du Fard Sàrl. This option remains discretionary, and Atelier du Fard Sàrl reserves the right to refuse or cancel it without justification.
    6. In the event of prior agreement for deferred payment, the payment period is 21 days from the invoice date, unless otherwise stated on the invoice.
    7. In case of late payment:
      1. A first reminder is sent free of charge.
      1. A second reminder will incur a fee of CHF 10.
      1. A final reminder (formal notice) will incur additional administrative costs of CHF 20 as well as default interest of 5% per annum, calculated from the due date.
    11. Atelier du Fard Sàrl reserves the right to suspend any order or delivery in progress and to withdraw access to payment on invoice in the event of non-compliance with the terms and conditions.
    12. If necessary, the file may be forwarded to a debt collection agency, with the costs being borne by the customer.

  13. Delivery

    1. Les commandes peuvent être livrées à domicile ou retirées en personne au showroom de Atelier du Fard Sàrl.
    2. Orders will be processed within 48 hours on average after confirmation. In the event of a delay, we will inform you as soon as possible. If the processing time is longer than expected, you will have the option to change your selection and request home delivery. In this case, you will be responsible for the delivery charges.
    3. Delivery costs are calculated based on the weight of the products and the destination. They will be specified when you place your order.
    4. Atelier du Fard Sàrl cannot be held liable for the consequences of a delay in delivery caused by a third-party carrier.

  15. Customs Duties

    1. Customs duties, import taxes or other local charges may be applicable by the authorities of the destination country. These costs are not included in the price of the products or in the delivery fees charged by Atelier du Fard Sàrl. They are the sole responsibility of the buyer and are to be paid on delivery.
    2. The buyer is solely responsible for consulting the authorities in their country regarding any customs duties or import restrictions.
    3. Atelier du Fard Sàrl cannot be held responsible for any customs delays, delivery delays due to postal or customs services, or additional costs charged by your local authorities.

  17. Cancellation and Returns

    1. All sales are final. Once an order has been placed, it cannot be returned and there is therefore no right of retraction, except in cases provided for by law.
    2. If you change your mind after placing an order, you can contact us by email to request the total or partial cancellation of your order. Cancellation will only be possible if the order has not yet been processed.
    3. For pre-orders, cancellation or modification is only possible if the item has not yet incurred any costs for Atelier du Fard related to its purchase or order. Once costs have been incurred to fulfil the pre-order, cancellation or modification will no longer be possible.
    4. Acceptance of the cancellation remains at the sole discretion of Atelier du Fard Sàrl.

  19. Faulty Items

    1. In the event of an error or defective product, please contact us within 10 days of receipt, attaching photos showing the problem.
    2. After validation of the fault, and should the customer not wish to return the product, they may choose either a partial refund of 50% of the product price, a voucher for the total value of the product, or, if the product is still available, a replacement at no additional cost.
    3. A full refund is only possible when the product is returned by the customer.
    4. Return shipping costs are the responsibility of the client and may be refunded in the form of a credit to their customer account, upon presentation of proof of delivery from the carrier, only if the returned product is confirmed as faulty and/or incorrect by Atelier du Fard Sàrl.

  21. Warranty and Liability

    1. The products are covered by the legal guarantee of conformity and the guarantee against hidden defects.
    2. Atelier du Fard Sàrl cannot be held responsible for misuse of products or results that differ from personal expectations. The instructions provided by manufacturers must be followed.
    3. The advice, instructions, or information provided on the Website or during exchanges with the team are provided for informational purposes only and are not intended to replace manufacturers' instructions or healthcare professionals' advice.

  23. Force Majeure

    1. Atelier du Fard Sàrl cannot be held liable for any failure or delay in performance resulting from a case of force majeure within the meaning of Swiss law, in particular in the event of a natural disaster, pandemic, fire, flood, strike, war, terrorist act, general breakdown, administrative decision, interruption of transport or postal services, customs blockage, or any other event beyond its control. Obligations shall be suspended for the duration of the force majeure event.

  25. Personal Data Protection

    1. Atelier du Fard Sàrl collects and processes your personal data in accordance with data protection legislation. For more information, please see our Personal Data Protection Policy.

  27. Intellectual Property

    1. The content of the Website is protected by copyright. The texts, images and photographs created by Atelier du Fard Sàrl remain its property.
    2. Certain content (photos, descriptions, logos) belongs to the brands distributed and is used subject to their consent.
    3. Any unauthorised use of the content of the Website is prohibited.

  29. Coming to the Showroom

    1. It is also possible to visit the Atelier du Fard Sàrl showroom in person to view and test the products. The terms and conditions of purchase applicable when visiting the showroom are the same as those applicable on the Website.
    2. For information regarding opening hours and access to the showroom, please consult the Website or contact us directly.

  31. DPro Discounts for Professionals

    1. Atelier du Fard Sàrl offers a discount program for professionals in the makeup industry. This program is divided into different levels:
      • Professionals: Freelance make-up artists working in opera and theatre productions, on film or television shoots, resellers. Gives access to a 30% discount on most products. To be renewed every 2 years.
      • Artistes : Comédiens, chanteurs, danseurs, cosplayers, artistes drag. Donne accès à 10% de réduction sur la majorité des produits. À renouveler tous les 2 ans.
      • Étudiants : Maquilleurs en formation ou ayant récemment (moins de 6 mois) terminé une formation en maquillage d'une durée totale d'au moins 6 mois. Donne accès à 15% de réduction sur la majorité des produits pendant 1 an.
      • Secouristes : Moniteurs et instructeurs de secourisme ou organismes de formation dans le domaine des secours. Donne accès à 15% de réduction sur les produits d'effets spéciaux. À renouveler tous les 5 ans.
    3. You must already have an online account with Atelier du Fard or create one to access the discounted rates.
    4. Your access to discounted rates is personal and non-transferable. Atelier du Fard Sàrl reserves the right to withdraw access to the programme from any person in the event of abuse, without prior notice.
    5. Professional discounts cannot be combined with other promotions.

  33. Governing Law and Jurisdiction

    1. These GTC are governed by Swiss law. Any dispute relating to their interpretation, validity and/or execution shall be subject to the exclusive jurisdiction of the courts of the canton of Vaud, where Atelier du Fard Sàrl has its registered office, subject to any mandatory jurisdiction.

  35. Changes to the Terms and Conditions

    1. Atelier du Fard Sàrl reserves the right to update these Terms and Conditions at any time. Changes will apply to orders placed after they are published on the Website.
